Passing Off
Our client discovered that a company with a similar name had entered into its market and the confusion between the two companies was causing it damage. After investigating all the relevant facts and obtaining evidence that we required, we were able to advise our client that they had a claim for unregistered trade mark infringement (in legal speak, 'passing off').
Our client requested that we ensure the other company:
- altered its name to another that would not cause confusion
- informed its customers of the change
- changed all its signs etc where the old name was used.
Following our initial letter to the other company, we resolved the matter within two months and achieved all of our clients’ objectives
